World Day Against the Death Penalty: Crime Si Poa® Champions Justice, Dignity, and Community Safety in Kenya

As the world commemorates World Day Against the Death Penalty, Crime Si Poa® stands at the forefront of Kenya’s movement for justice, dignity, and community safety.
Kenya remains abolitionist de facto, with no executions since 1987. Yet courts continue to sentence individuals to death for capital offences, sustaining an environment of fear and uncertainty for those on death row and undermining the right to dignity and humane treatment.
Death Penalty and Community Safety
At the National Death Penalty Conference, themed “The Death Penalty and Community Safety in Kenya: Separating Myth from Reality,” Crime Si Poa® #CrimeSiPoa, reiterated that the death penalty does not enhance public safety.
“The death penalty is a relic of retributive justice. It neither deters crime nor addresses the root causes of violence in our communities,” stated Crime Si Poa®.
“It perpetuates systemic injustice, disproportionately affecting the poor, marginalized, and those lacking access to fair legal representation.”
Recognizing Progress, Advancing Reform
Crime Si Poa® celebrates Kenya’s progress toward a more humane justice system:
The Supreme Court’s Francis Muruatetu judgment, which declared mandatory death sentences in murder cases unconstitutional
Presidential commutations by Mwai Kibaki (2009), Uhuru Kenyatta (2016), and William Ruto (2023), guided by the Committee on the Power of Mercy (POMAC) under Article 133 of the Constitution
These reforms are crucial milestones, yet full abolition remains the clearest demonstration of Kenya’s commitment to human rights, rehabilitation, and restorative justice.
